These General Terms and Conditions (hereinafter referred to as GTC) specify the conditions for the use of the services available on the rotationalmouldingtools.com website (hereinafter: the website) by the user (hereinafter: User). The technical information required for using the website, not covered by these GTC, is provided in the information available on the website. By using the website, the User acknowledges and accepts the provisions of these GTC.

4.1. Liability

The User may use the website solely at their own risk, and it is accepted that the Service Provider is not liable for pecuniary and non-pecuniary damages arising from the use, beyond liability for intentional, grossly negligent, or criminal actions causing harm to life, physical integrity, or health. The Service Provider disclaims all responsibility for the behavior of users on the website and for which the User is fully and exclusively responsible. Users must ensure that they do not violate the rights of third parties or laws directly or indirectly during the use of the website. The Service Provider is entitled, but not obliged, to check the content made available by users during the use of the website and is entitled, but not obliged, to look for signs of activities that may indicate unlawful conduct, and is not responsible for such content.

5.1 Order Process

The structure of our online store provides convenient and quick navigation for customers using menu options to browse the store. You can first see the categories in the store. If you enter a category where products are available, you can view the name, price, and image of the products. By clicking on the basket icon, you can add the product to your cart. If all the products in a category cannot fit on one page, you can paginate using the numbers above and below the products. Each product indicates the start and end date of the promotion or "while stocks last." If you want more information about a product, click on its image or name. This will take you to the "Product Details" page. You can also search the store. For a simple search, just enter the search word, and if any product matches, the system will display it. Under the "Information" menu, you will find all the essential information about the store. You can check the contents of your cart by clicking on the "Cart" button. Here you can modify the quantity of the product in your cart or delete the item. You can also choose to empty the entire cart by clicking the "Empty Cart" button. If you decide to place an order, click on the "Order" button. If you want to buy from the online store, you need to provide the data necessary to fulfill the order, such as contact details, shipping, and billing information. For your convenience later, you can register in our store, so after entering your email and password, you can immediately continue shopping without re-entering your data. In case of unsuccessful login, you will receive a notification in a pop-up window. If the login is successful, the logout button will appear, which you can use to leave the store, and a "Modify Data" menu will appear where you can modify the data provided during registration. If you are a registered customer but have forgotten your password, use the new password request feature. If you provide your registered email address here, we will send you a new temporary password by email. Please use this to log in and immediately change it for security reasons. If you click the order button on the cart page, you will reach the "Payment and Shipping Methods" page, where you need to choose the most suitable payment and shipping method for you. There is no option for partial delivery in our online store. To continue, press the "Next" button. Then, all the data of your order will appear, so you can check them. Our online store offers 3 payment options: "cash on the spot" (in case of personal pickup at our headquarters or upon delivery), "cash on delivery" (in case of postal delivery), "bank transfer" (in this case, we will send you the invoice before pickup). If everything is correct, press the "Order" button to finalize your order. HD-Rotatech Kft. will always send a written notification to the customer about the handover of the products to the courier service or by post, but the actual delivery of the products is subject to the business regulations of the current carrier. Our company cannot take responsibility for any problems that may arise during deliveries by courier services. If the products cannot be delivered within the delivery time specified in the carrier company's business regulations and they return to HD-Rotatech Kft., the cost of redelivery is borne by the customer. You can track the status of your order until the order is closed using the "Profile" menu. Here you can find the number and amount of all your orders placed in our store. Each order is identifiable by a unique order number, and by clicking on it, you can view the detailed data of the order. You can even print your order, fill your cart with the data in the order, and pay the invoice for credit card payments or choose another payment method. If you have any discounts in the store, you can also view them by clicking on the "Discounts" tab.

  1. Right of Withdrawal

6.1. Procedure for Exercising the Right of Withdrawal

The provisions in this section apply exclusively to natural persons acting outside their profession, independent occupation, or business activity, who buy, order, receive, use, or make use of products related to commercial communication and offers (hereinafter: Consumer). The Consumer has the right to withdraw from the contract within fourteen (14) days from the day of receipt of the product, in the case of a service contract after the performance of the service, without giving any reason. The Consumer may exercise their right of withdrawal during the period between the conclusion of the contract and the day of receipt of the product. If the Consumer wishes to exercise their right of withdrawal, they are obliged to send their clear statement of withdrawal to the Service Provider without delay (e.g., by mail, fax, or email) using the contact details provided in point 1 of these GTC. For this purpose, the Consumer can use the withdrawal statement template attached to the order confirmation email. The Consumer exercises their right of withdrawal within the deadline if they send their statement of withdrawal to the Service Provider before the expiration of the above-mentioned.

  1. Warranty

7.1. Legal Warranty

In case of defective performance by the Service Provider, the User may assert a warranty claim against the company in accordance with the provisions of Act V of 2013 on the Civil Code. In the case of a consumer contract, the User qualifying as a Consumer may enforce warranty claims within a 2-year limitation period from the date of receipt for defects existing in the product at the time of delivery. Beyond the two-year limitation period, the User cannot assert legal warranty rights. If the contract is not with a Consumer, the User may assert warranty claims within a 1-year limitation period from the date of receipt. The User may, at their discretion, request rectification or replacement, unless the fulfillment of the chosen option would be impossible or would involve disproportionate costs for the business compared to another remedy. If the User did not request or could not request rectification or replacement, they may demand a proportionate reduction in the consideration or, at the expense of the business, rectify the defect themselves or have it rectified by another, or, in the final instance, withdraw from the contract. The User may switch to another warranty right, but the cost of the switch is borne by the User unless justified or prompted by the business. The User is obliged to notify the defect immediately, but no later than two (2) months after discovering the defect. The User can assert their legal warranty claim directly against the business. In the case of a defect recognized within six months of performance (i.e., delivery and acceptance), it must be presumed that the defect already existed at the time of performance unless this presumption is incompatible with the nature or characteristics of the defect. The Service Provider is exempt from liability for warranty if it overturns this presumption, i.e., proves that the defect arose after the product was handed over to the User. In this regard, the Service Provider is not obligated to accommodate the User's objection if it adequately proves that the cause of the defect is a consequence of the product's non-compliant use. However, after six months following performance, the burden of proof is reversed, meaning that in case of a dispute, the User must prove that the defect already existed at the time of performance.

7.2. Product Warranty

Product warranty arises exclusively in the case of a defect in a movable item (product). In this case, the User qualifying as a Consumer may, at their discretion, enforce either the right specified in Section 7.1 or a product warranty claim. As a product warranty claim, the User may only request the repair or replacement of the defective product. The product is considered defective if it does not meet the applicable quality requirements at the time of placing it on the market or if it lacks the properties specified in the manufacturer's description. The User may assert their product warranty claim within two (2) years from the date of the product's distribution by the manufacturer. After this period, the right is forfeited. The User can only enforce their product warranty claim against the manufacturer or distributor of the movable item. The User must prove the defect when asserting a product warranty claim. The manufacturer (distributor) is only exempt from product warranty obligation if it can prove that: the product was not manufactured or placed on the market in the course of its business activities, or the defect was not recognizable at the time of placing on the market based on the state of science and technology. It is sufficient for the manufacturer (distributor) to prove one reason for exemption. The same defect cannot be asserted as both a legal warranty and a product warranty claim concurrently. However, if a product warranty claim is successful, the User can assert their legal warranty claim against the manufacturer. Tanks are sold with non-lockable covers in basic configuration, meaning they are not suitable for installation in places exposed to either vehicular or pedestrian traffic, and they cannot be locked, i.e., they can be easily lifted or removed. If the tanks are to be installed in a location exposed to pedestrian or vehicular traffic or in a place where a lockable or higher load-bearing capacity cover is required for safety reasons, the manufacturer can provide a suitable cover upon special request. The operator must always ensure the proper securing of covers on tank manholes during installation and regular use! Any problems of this nature that arise during operation and resulting damage incidents are entirely the responsibility of the operator (foreign material enters the tank, someone falls in, etc.). The manufacturer assumes no responsibility for damages arising from improper operation, personal injuries.

7.3. Guarantee

Regarding the mandatory guarantee for individual durable consumer goods, provisions are laid down in Government Decree 151/2003 (IX. 22.) on the Mandatory Guarantee for Certain Durable Consumer Goods. The scope of the regulation applies only to new products sold within the territory of Hungary under a consumer contract and listed in the annex to the decree. For durable consumer goods listed in the annex to the government decree, the mandatory guarantee is one year, starting from the date of delivery of the product to the Consumer, or if the installation is carried out by the Service Provider or its authorized representative, the date of installation. The business is exempt from the obligation of guarantee if it can prove that the cause of the defect occurred after performance. For the same defect, the User cannot assert both legal warranty and guarantee claims, or product warranty and guarantee claims concurrently. Otherwise, the User is entitled to guarantee rights independent of the entitlements specified in Sections 7.1 and 7.2.

  1. Enforcement of Rights

8.1. Place, Time, and Method of Complaint Handling

The User can submit consumer complaints related to the product or the Service Provider's activities using the following contact details:

The Service Provider shall promptly remedy verbal complaints if possible. If immediate rectification of verbal complaints is not possible due to the nature of the complaint or if the User disagrees with the complaint handling, the Service Provider shall prepare a report on the complaint – along with its substantive response – which will be kept for five years. In the case of a verbal complaint made in person (at the business premises), the Service Provider shall provide the User with a copy of the report on the spot or, if not possible, shall proceed according to the written complaint rules detailed below. In the case of a verbal complaint conveyed by phone or other electronic communication services, the Service Provider shall send a copy of the report to the User simultaneously with the substantive response. In all other cases, the Service Provider shall proceed according to the rules for written complaints. Complaints recorded by phone or other communication means will be assigned a unique identifier by the Service Provider, simplifying later retrieval of the complaint. The Service Provider shall respond substantively to written complaints within 30 days. Dispatching by mail constitutes completion under this agreement. In case of rejection of the complaint, the Service Provider shall inform the User of the reasons for the rejection.

8.2. Other Means of Legal Enforcement

If a consumer dispute between the Service Provider and the User is not resolved through negotiations, the User has the following legal enforcement options: filing a complaint with the consumer protection authority, initiating a mediation procedure (the contact details of the relevant Arbitration Board, competent based on the Service Provider's registered office, must be indicated), initiating a court procedure.

  1. Miscellaneous

9.1. Modification of the Terms and Conditions, Prices

The Service Provider may modify these Terms and Conditions, the prices of products sold on the website, and other indicated prices with non-retroactive effect at any time. The modification becomes effective after being published on the website and applies only to transactions that occur after its entry into force.

9.2. Technical Limitations

Purchasing on the website assumes that the User is aware of and accepts the possibilities and limitations of the Internet, particularly regarding technical performance and potential errors. The Service Provider is not responsible for any operational malfunctions in the internet network that prevent the website's operation and transactions.
